We
appreciate that outstanding debts can cause financial problems
for any commercial business and we therefore aim to provide
our clients with an efficient debt recovery service. We will
strive to recover outstanding balances as quickly as possible,
with the minimum of inconvenience. We will pursue all amounts
required and currently act for sole traders, partnerships
and limited companies. We are also retained by several national
companies to recover their outstanding invoices upon a regular
basis and are happy to discuss similar arrangements with
new clients.
From our experience we have found that a solicitor’s
letter demanding payment can often be an effective and cost
efficient way of obtaining payment.
Unfortunately you may sometimes need to consider issuing
proceedings against the debtor. We have found that it
is useful at this stage to carry out a Company search or
EJO and Bankruptcy searches against the debtor to verify
their current financial status. We will obtain these searches
upon your behalf to assist you in making the decision to
issue proceedings.
We have considerable experience of issuing proceedings in
the Small Claims Court, County Court and High Court for recovery
of debts and will then proceed to obtain a Decree against
the debtor. When a Decree has been obtained we will then
make an application to the Enforcement of Judgements Office.
The EJO has a wide range of powers to investigate and to
issue orders against the debtor, such as an attachment of
earnings order.
Should the debt be disputed we will provide you with advice
and representation at Court.
Should you wish to consider the option of bankruptcy proceedings
we can advise you through every step of the procedure and
ensure that all necessary documents are prepared and lodged
with the Bankruptcy Office. Bankruptcy proceedings are commenced
by serving a Statutory Demand on the debtor and can be an
effective way of obtaining prompt payment from debtors.
Our case computerised case management system ensures that
all deadlines and time limits are adhered to allowing your
debt recovery to be progressed as quickly as possible.
